Chandigarh: In a fresh set- back to the UT contractual employees, the UT personnel department has categorically said that they don’t have any rights to continue on the posts currently held by them.

In a letter to the secretary, education, the personnel department on Thursday wrote, “There is no right available to contractual employees to continue on the post and no right can be said to have been taken away if the respondents have decided to conduct regular selections.” The directions are applicable to all the UT departments.

The personnel department has also said the Chandigarh administration should take steps for conducting regular selections at the earliest, preferably within a period of six months by issuing appropriate advertisements and inviting applications. “Age relaxation may be granted to the persons, who have already been working with the education department on contract basis so that they may also participate in the selection process,” the letter said.

Several contractual employees, particularly from the education department, have approached the Central Administrative Tribunal (CAT) on the issue, and “the letter will also be quoted to clarify the UT stand on the issue, which is as per high court and Supreme Court orders,” said the official.

Upholding the March 4 order of the administration on contractual employees, the high Court had directed it to hold regular recruitment within six months for the posts currently held by such employees. The court had held,

“This court has time and again observed that cont ractual appointments on permanent posts are not in consonance with the basic principles and ethos of the Constitution envisaged under Article 14 and 16. It deprives the qualified candidates from participating in the selection process and encourages back-door entries. The UGC regulations of 2010 laid down the method and manner of selection of various teachers in the universities and affiliated colleges.” In its March 4 order, UT had directed all departments to ascertain requirements against the vacant posts or deemed abolished posts, send proposal to line ministry for filling these up with regular recruitment against alive and sanctioned posts at the earliest.
