Chandigarh: The Punjab and Haryana high court has asked the Haryana govt to explain why no members have been appointed in the state’s Real Estate Appellate Tribunal having just a chairman.
Posts of two members in the tribunal headed by retired high court judge Justice Rajan Gupta have been lying vacant for the past several months.
“Notice of the case be is sued to the state of Haryana to explain as to why no member other than the chairman of the Real Estate Appellate Tribunal, Haryana, has been appointed so far, despite the fact that in absence of the members, the tribunal has been rendered as defunct,” said Justice Rajbir Sherawat of the high court in his orders passed on a plea filed by real estate promoter Brahma City Private Limited against a decision passed by Haryana Real Estate Regulatory Authority (Rera).

Take instructions from the govt on why a retired addi-tional district judge in Haryana is not considered as district and sessions judge for appointment to various posts, a practice followed in all other states. Even the state of Punjab is treating them at par.
The next hearing is on Nov 11.
Haryana has two benches of Rera in Gurgaon and Panchkula. The Real Estate Regulatory Authority hears complaints against builders/real estate companies for violations of conditions related to flats or buildings. Appeals against Rera decisions are entertained before the Rera tribunal.
