Shubhkaran death: Pb, Hry notice over plea for CBI probe

Chandigarh: Taking cognizance of a plea seeking a CBI probe into the death of farm activist Shubhkaran Singh, who allegedly died in Haryana Police firing at the Khanauri border protest site this Feb, the Punjab and Haryana high court has issued notice to state govts of Haryana and Punjab, seeking their reply.

Justice Karamjit Singh has issued notice after hearing a petition filed by Subhkaran’s father, Charanjit Singh. Counsel for the petitioner submitted that an FIR regarding the death was registered under sections 302 and 114 of IPC at Patran police station in Patiala district on Feb 28.

Medical Report- The medical report of 21-year-old Shubhkaran Singh from Bathinda had suggested head injuries as cause of death.

It was stated that officials of Haryana Police started firing in- discriminately on protesting farmers when the death took place.

The petitioner’s counsel submitted that after registration of FIR, neither police authorities of Punjab nor of Haryana made any further investigation. Being aggrieved, the petitioner filed a petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking transfer of investigation in FIR to a neutral investigation agency like CBI After hearing the plea, HC asked both states to file responses on petitioner’s contentions. The matter has been adjourned to Dec 17.

On March 7, a division bench of the HC had ordereda three-member panel headed by Justice Jaishree Thakur, a former judge of the Punjab and Haryana high court, assisted by two ADGP-rank officers (Amitabh Dhillon of Haryana and Pramod Ban of Punjab), to probe the matter. On the panel’s recommendations, the investigation pertaining to the death of Subhkaran Singh was handed over to IPS officer Satish Balan.
