Man accused of abetting friend’s suicide gets bail.

Mumbai: Observing that prima facie the charge of abetment of suicide is not made out as there were no allegations of instigation or goading, a sessions court granted bail to a 27-year-old newly-wed Vikhroli resident two months after he was arrested for abetting the suicide of his female friend.

The woman’s mother claimed that the accused, Pradip Gupta, promised to marry her daughter, Sharmishta, and she was distressed after his wedding. Gupta denied the allegation. Additional sessions judge Gauri Kawdikar said, “On the basis of the FIR and statement of witnesses, prima facie ingredients of Section 108 (abetment of sui-cide) of the Bharatiya Nyaya Sanhita are not made out. , the victim herself attended the haldi as well as the marriage ceremony of the accused without taking any objection to the said marriage.”

The judge further said there are no criminal antecedents attributed to the accused. “He is a permanent resident of Mumbai. To facilitate investigation, the accused can be directed to attend the police station. To protect the complainant, ensure the presence of the accused for trial, and avoid future disputes, certain terms and conditions can be imposed upon the accused,” the judge said.
