Yet another case against the famous Kharar-based Bajwa Developers is decided by the Mohali District Consumer Redressal Forum on account of deficiency of services which is not giving possession on time.

Facts of the case are:
1 Complainant booked one bhk in Sec 74 Sunny Apartment F-21 Mohali for total cost of Rs. 12.52 lakhs on June 1, 2011.

2 Date of possession was to be given within 2 years but not given.

3 Without any statutory approvals, CLU or NOC of the project/land in question, the builder took the money .

4 Gmada only gave permission in May 2014.

5 Builder took the defence that the flat was meant for economically weaker wing akin EWS and the complainant misrepresented the facts. Though the possession was ready in June 2014.

6 District Consumer forum Mohalier held Bajwa Developers of Sunny Enclave to be deficient of services and thus ordered following reliefs:

A. Refund of Rs 3.12 lakhs at 12% interest
B. 20k as compensation amount
C. Litigation expenses 5 k.

Now the courts order need to be complied as and when certified copies are available.

If Kharar based Bajwa Developers file appeal in Punjab State Consumer Redressal Commission at Chandigarh Sector 37, the party May file a caveat to prevent stay on the Mohali Consumer court’s order.
