LACCUNA IN SERVICES COSTS TO INSURANCE COMPANY

A consumer is a person who pays money to consume goods & Services. So, he/She has a right to get expected quality of goods & services. But many times, they become victims of fraud by service providers. As recently in a case, the Panchkula District Consumer Dispute Redressal Forum penalized the Oriental Insurance Limited Company, Sector 17 Chandigarh for denying the insurance claim for replacement of a car engine.

Facts of the Case:

In 2016, Complainant Mahim Suden r/o sector -30 B, Chandigarh purchased the Renault Kwid Car and also insured the car in Aug, 2016.

Near Amartex in Panchkula, car met with an accident & then she called for assistance on toll-free number of Renault India Pvt. Ltd but that was not available.

Then she got towed the car to an agency in Panchkula where she was informed that engine oil tank of the car was damaged and got replaced.

She filed a claim of Rs, 42,142 from the insurance firm but firm rejected the claim. Then she moved to forum.

Insurance company filed reply that according to terms & conditions of the policy , engine can only be replaced when there is a manufacturing defect.

 After considering all the facts, forum held liable to the insurance company on their lacuna of not visiting on the site to have firsthand knowledge of the facts & circumstances because non-visiting of the site by surveyor while assessing the loss to the damaged vehicle is serious lacuna & same is fatal for the opposite party.

Forum directed to insurance company to pay Rs, 31,600 which is 75% of the total in voice amounting Rs. 42,142 along with 9% interest per annum plus Rs 10,000 on account of mental agony & harassment & Rs. 5,500 as a litigation fee to the complainant.

So, consumer   must be aware of his rights and if any service provider denies your right, you can claim it.
