Government Private Aided Schools Staff eligible for ACP & Pension- High Court

Benefit of Regularization into Government Job for staff who served tenure in Aided Schools.

Staffs who have given services in government-aided private schools of Haryana would be considered for ACP and pension Calculation on their regularization in government job.

The verdict of PHHC in 2015 in UMA Devi’s case has been upheld by the division bench of High Court, Chandigarh.

The Haryana government preferred the appeal against 2105 order but there was a delay of 1434 days in filing the appeal.

There was no sufficient reason with State authorities to delay the matter for so long.

In 2013, 51 petitioners had come to PHHC to treat services by petitioners at par with regular on account of pension, pensionary benefits and other consequential benefit. The sole defence of State was the employees did not contribute to control provident fund (CPF), therefore the record cannot be verified.

High Court allowed the writ on July 24, 2015 directing petitioners to give record with the schools concerned and State to verify the school records.

The entire exercise was to complete within one year but was not computed.

Thus State challenged these orders in appeal.

The contempt petitions are pending before the Hon’ble High Court Chandigarh for the same issue.

This decision will give finality to 2015 order and pave the way for petitioners to get the benefit as desired from this petition.

Now those who worked in Private aided school will get ACP and other pensionary benefits on joining regular service after this decision. Yet another master judgment of PHHC on the issue of service matter.
