CONSUMER FORUM ORDERS TO SEAL OFFICE OF JALANDHAR IMPROVEMENT TRUST CHIEF
Punjab State Consumer Disputes Redressal Commission has directed the Jalander Deputy Commissioner to seal the office of Jalander Improvement Trust Chairman, Daljit Singh Ahuwalia for not releasing pending dues of a flat allottee in the city.
In the present case the complainant, Sukhdev Singh Sehgal had approached the consumer forum seeking their money back after the Jalander Improvement Trust (JIT) failed to handover the flat to the allottees in Surya Enclave Extension. The JIT officials refused to return the money to the flat allottee before the next hearing.
The commission pointed out to the fact that the non-bailable warrants issued against the JIT chairman to the police commissioner on June 7 have not been returned back – executed or unexecuted. The commission thus issued fresh non-bailable warrant against the JIT chairman for procuring his presence inorder to frame charges on July 16. The court ordered that it is directed that if the warrants are not executed upon then the police officials deputed to execute the warrant should appear before the commission for recording their statement for initial proceedings under sections 82 and 83 of the Code of Criminal Procedure.
Through this judgement the court took notice of the fact that the complaints which date back to 2014-15 and Execution Applications of 2015-16 have not been complied with and therefore the court was bound to take coercive measures.
The commission directed the Jalander Deputy Commissioner to submit a compliance report on sealing of the office before July 16. Furthermore, the commsion not only issued fresh non bailable warrants against the JIT chairman but also directed a fresh letter to be written to the police commissioner inorder to look into the matter personally.
