Introduction

Two years after a four-year – old girl was murdered by a worker who held grudges against the child’s parents, the District Legal Services Authority (DLSA) awarded the victim 10 lakh to compensate the victim’s family. Facts of the case

The defendant, Kamlesh, who lived in the Labor Colony in the Industrial Zone, Phase 1, was a friend of the victim’s family. Envious of her father’s samosa stall, he cut the girl’s throat with a sickle in full public view on 25thFebruary, 2018.In August 2019, Kamlesh was granted life imprisonment until natural death by a district court which was found guilty of “cold-blooded murder.” The court also ordered that the family be paid. Compensation sum was issued after an investigation by Chief Judicial Magistrate-Cum-Secretary, District Legal Services Authority, Chandigarh, Ashok Kumar Mann and as part of the Victim Assistance Program, 2012.

The murder case was reported on 25 February 2018. According to the FIR, the girl — Ujala — lived here with her family, and Kamlesh was her neighbor. Ujala had been out to practice that day. After a while, the neighbors raised the alarm and told her mother that Kamlesh was threatening her with a knife. Everybody hurried to the spot, and by the time the girl was released from her clutches, she was dead.

Legal Standpoint

On Thursday, the family was called and the sum of compensation was given to the Chief Judicial Officer-Cum-Secretary, DSLA, Chandigarh, Ashok Kumar Mann as part of the Victim Assistance Scheme, 2012.The court has ordered that the file concerning the award be transferred to the legal service authority. It was issued by DLSA on 11thAugust and today the award was approved.

Conclusion

Punjab and Haryana High Court Judge and Chief Executive Officer of SLSA, Chandigarh, Justice Jaswant Singh, have issued instructions that in cases where the court has recommended compensation to the victim / kin, there should be no delay in doing so.
