Recently an applicant who applied for the post of Assistant Sub Inspector (ASI) knocked the doors of CAT Tribunal for Chandigarh against the rejection of his representation to UT Chandigarh Police.

The order dates back to October to 26, 2016 whereby her candidates for the post of ASI was rejected on the grounds that the post lying was for male general not female category despite of the fact that she was higher in merit by scoring 59 marks and standing 16 on the list.
The applicant just Jaskirandeep Kaur, had challenged another order of Mr Suresh Kumar (OBC category) who was 18th on the list and still got appointed violating articles 14, 15(3), 16(1) of Constitution of India.
Now she is Before The Central Administrative Tribunal situated at Chandigarh for getting directions to be considered for the ASI post without discrimination on the pretext of being a woman.

The Test was conducted in 2007 comprising both of physical measurement and efficiency Test followed by a written test. The successful applicants were then called for the interview. Due to some reason the process couldn’t mature and the recruitment was challenged and then conducted again in 2011 followed by the interview where Ms Kaur got 59 marks and rank 16 whereas Suresh Kumar got 58 and rank 18 and still got the appointment.
Ground of Rejection– That Ms Kaur can’t be considered for the post reserved against male general and claim can only be satisfied for two general female category posts. On this view of the authority/Chandigarh police, she has to move to the court.
The reasoning given was Ms. Kaur was not able to score higher in the female category and thus she was not selected for the two posts based on Merit.
As per the advertisement dated February 2007 there were 20 temporary post of ASI Chandigarh Police in the pay scale of 4550 & 7220 the post.

Now the CAT Tribunal has to test the orders in light of the constitutional provisions. we hope the justice be soon meted out to the applicant.
