Acquittal Due to Lack of Evidence

AMBALA  MAN  ACQUITTED  OF  CHARGES  OF  DAMAGING  PUBLIC  PROPERTY  DUE  TO  LACK  OF  PROOF

An Ambala resident was accused of wrongly driving a car with the wheel clamp attached by the traffic police. The traffic police on their complaint said that, on their duty they had attached wheel clamps on the front and back wheels on the driver side over the car of the Ambala resident since he had wrongly parked his car. But, the Ambala man without minding the wheel clamps, had driven away his car that had resulted in the damage of the wheel clamps. A case was registered against him u/s 3 of the Prevention of violence and damage to public property Act which imposes prohibition on individuals from damaging a public property.

However the court held that the police had failed to prove the case against the defendant and so the Ambala man was acquitted.

MY OPINION:

CCTV cameras play a pivotal role in these kind of cases. A keen observance of the CCTV footage of the incident can surely lead to a just decision by the court.
