Subhash Bansal, director of Shiva Enclave in Kharar, Mohali has been booked by the police under the PAPRA Act for not providing basic amenities to the residents of his housing society. The complaint was filed by Paramjeet Singh, deputy director of the local bodies department. In his complaint, the deputy director stated that the builder failed to provide basic amenities to the residents living in his housing society despite repeated requests by them.

The police officer investigating the case said that the residents had lodged a complaint against Shiva Enclave with the Punjab Local Bodes department alleging that the builder failed to provide them with drinking water and the condition of internal roads was also in very bad shape. Over 100 families live at Shiva Enclave and have been complaining about the lack of facilities since 2018. A resident of Shiva Enclave stated that a notice was issued to the builder that the residents were living without basic amenities such as erratic water supply, bad roads and no power backup.

 He claimed that the residents were promised that these facilities would be available to them when they bought the property. The police booked Subhash Bansal under Section 36(3) of the Punjab Apartment and Property Regulation (PAPRA) Act which states that. “Any promoter or estate agent who, without reasonable excuse, fails to comply with, or contravenes, any other provision of this Act or of any rule made thereunder, or does not pay the penalty imposed on him by the competent authority, shall, if no other penalty is expressly provided for the offence, be punished on conviction, with imprisonment for a term which may extend to one year, or with fine which may extend to ten thousand rupees, or with both.” [1]

Since the builder failed to provide basic amenities to its residents which was something which was promised by him when the property was bought by the residents, he violated the Punjab Apartment and Property Regulation Act 1955. This could lead to a maximum jail term of about three years. The accused however has not been arrested yet. The PAPRA Act of 1955 has been enacted with a view to regulate the promotion of the construction, transfer and management of apartments on ownership basis, to regulate colonies and property transactions and to provide for registration of promoters and estate agents and enforcement of obligations on promoters and estate agents and for matters connected therewith or incidental thereto.[2]

This basically means that all matters related to promotion, construction, transfer and management of apartment on the basis of ownership are regulated by this act in the state of Punjab. According to reports, this is the first case in almost two years where a builder has been booked for not providing basic amenities that were promised to its residents.
