The prestigious 2003 Arjuna Award Winning Suraj Lata Devi’s involvement in the 2002 Common Wealth games inspired the bollywood movie “Chak De India”. Yet Domestic Violence has not spared Devi from horror in the safe haven of her home.

Shanta Kumar Singh, a former hockey player from Sultanpur Lodhi married Suraj Lata Devi, another hockey player captain from Manipur, in February 2005. A complaint was filed by Suraj Lata Devi where she was beaten by her drunkenly stupefied husband on November 8, beaten her black and blue while her tying he legs. Again, an attempt was made by her husband 5 days later but she managed to escape to Manipur. There she tried to file a complaint but the Manipur police notified the Sultanpur Lodhi, Kapurthala, Punjab Police, where the FIR was registered.

The violent act was as nightmarish as any women would never dare to imagine. Devi claimed that her husband mentally and physically tortured her because she refused to transfer her agriculture land to his name.

Police have booked Shanta Kumar Singh under sections 325 (voluntarily causing grieving hurt), 343 (wrongful confinement for three or more days), 354 (assault or criminal force to woman with intent to outrage her modesty), 498A (husband or relative of husband of a women subjecting her to cruelty) of the Indian Penal Code (IPC).

Even though this is a Domestic Violence matter, it does not fall under the Prevention of Women from Domestic Violence Act 2005, since the act lives up to its name, what it is meant for is: Prevention.

If the husband had not physically hurt Devi, and only mentally tortured her by threat of any kind, then the Prevention of Women from Domestic Violence Act 2005 (DV Act) would have been in play to her prevent the physical abuse. Since the husband has passed the point of no return and raised his hand at Devi, hurt her brutally, the DV Act has flown out of the window and the Criminal Procedure Code (CrPC) has taken place.

This action by the husband may have surprised Devi, but will be of no surprise to her if it happens again. She has the full discretion to file for divorce under the Indian Divorce Act 1869, under section 13 and 23A of the Hindu Marriage Act, dissolution by decree or under section 14 of the Indian Divorce Act 1869.
