IN A CASE OF ABETMENT TO SUICIDE, HIGH COURT DENIED ACCUSED PRE-ARREST BAIL PLEA

While dismissing anticipatory bail plea of the petitioner, Gagan Inder Singh, a resident of Faridabad, who was booked for abetment to suicide, Justice H S Madan of Punjab and Haryana High Court ruled that the purpose of anticipatory bail is to save innocent person from harassment and inconvenience and not to shield guilty persons and criminals from custodial interrogation by the investigating agency. Court made it clear that anticipatory bail to an accused must be granted in very exceptional circumstances as “a person couched in comparative safety of the pre-arrest bail would certainly not disclose all the facts within his knowledge.”

                In present case High Court observed that “The allegations against the petitioner are very grave and serious of abetting suicide of a young woman. His custodial interrogation is necessary for complete and effective investigation”.

Petitioner was booked by Faridabad police on complaint of a 63-year old Faridabad woman whose daughter, 39, was unmarried and owned a beauty parlour near NIT, Faridabad, had an affair with the accused and used to meet him frequently.

In her complaint, 63 year old woman alleged, “On June 14, the deceased had left with the accused and remained with him till her death on June 15. I was informed by my daughter’s friend that my daughter is going to commit suicide. By the time I reached the BPTP Bridge, my daughter had jumped off the bridge and died. Though she was taken to hospital, she was declared brought dead”. Complainant also claimed that her daughter had sent a message to her friend’s number that the accused and his family were responsible for her death and that the accused had deceived her.

On June 29, local court in Faridabad had dismissed his pre-arrest bail plea. Aggrieved from this, accused had then approached the high court.
