INTRODUCTION- PHHC Issued The Order While Dismissing The Plea Filed By Petitioner (Deputy Commandant, BSF) Who Had Sought Directions To Quash The Order Of March 24, 2020 Passed By BSF To Transfer Himfrom Chandigarh To Anupgarh, Rajasthan.
FACTS OF THE CASE- Petitioner, Who Was Posted As Deputy Commandant At Headquarters, Special Directorate General, BSF, Chandigarh Plead That He Was Due To Retire On Dec 31, 2022 & Before Retiring On Attaining The Age Of Superannuation, It Was Not In The Interest Of Administration (Involving Unnecessary Burden On The Public Exchequer) To Transfer The Petitioner To A Faraway Place. He Also Argued That There Was No Administrative Exigency To Transfer Claim.
He Had Sought Directions To Quash The Order Of His Transfer By PHHC.
FINDING OF THE CASE- High Court Dismissed The Plea Of BSF Officer Against His Transfer From Chandigarh To Rajasthan.
CONCLUSION- As Per PHHC It Is For An Employer To See Where He Requires Services Of An Employee And Employees, Especially Members Of Para-Military Force Supposed To Maintain Strict Discipline, Cannot Dictate Terms In That Regard Keeping Personal Interest In View Rather Than Showing Willingness To Serve Where Is Posted.
