District Consumer Disputes Redressal Forum ordered Ola Cab Service to pay Rs 17,000 to two government school teachers for bullying them after a driver complained to the police that one of the teachers who was travelling in the cab had snatched the car from him fraudulently. The instructor travelled with her two children, five and seven years of age.
Facts of the case
Sachin Sharma (44), Professor at Government Model High School (GMHS), RC-2 Dhanas, and Jyoti (42), Professor, GMHS, Sector 26, both Sector 23 residents, brought a consumer complaint against Ola. The complaint claimed that Sachin had booked an Ola cab for her friend Jyoti and her two daughters via the Ola app on 15 December 2019 at 3:20 p.m. from Sector 23 to Elante Mall. The cab reached the designated position at 3.24pm, but the cab was damaged and the driver said he had an accident yesterday.
They said that when the driver started from Sector 23 to Elante Mall, instead of moving from Sector 23 to Sector 22, he started to Sector 24 and turned to Sector 16 from the middle of Sector 15-16, when she interrupted him, he said he was moving according to navigation, and he reached Shanti Kunj from Sector 16, where the police had laid a naka. Upon reaching there, the driver said he ran out of fuel and pulled over. Jyoti told the driver that she might book another vehicle, but the driver asked her to stay in the car. After waiting for about half an hour, Jyoti called Sachin and told him what was going on. She told the cop at the naka. No one, on behalf of Ola, appeared to challenge the arguments of the complainants and chose to move against exparte.
After reviewing the documentary evidence provided by the complainants, the tribunal ordered Ola to pay Rs 10,000 as compensation for loss of operation, unfair market activity and abuse incurred by them and Rs 7,000 as litigants.
