They met 6 months back; he can’t be next friend: HC

Facts of the case :The petitioner no. 2 is the boy and the girl is petitioner no.1. it was submitted in the petition by the council for the boy that for the last 6 months the boy and the girl were in contact with each other after they fell in love. they decided to marry each other on attaining the age of majority. As per the bleeding when the relationship of petitioners  came to the knowledge of the girls family they turned against their alliance and therefore the petitioner and ran away from their respective houses on January 8th and are now living together. They were apprehensive that the family members of her family would cause harm to them so they submitted a representation to SSP Firozpur for protection of their life but no action had been taken. so the petition was filed by the couple from Punjab seeking protection to their life and liberty.

Decision of Punjab and Haryana High court:

Justice Manoj Bajaj while dismissing the petition filed by the couple held that only the parents, brother uncle being the natural guardian of a minor girl can be her next friend for the purpose of a protection. The court finds that petitioner number two allegedly became acquaintance of the girl only six months back and their heads relations develop recently. however in support of the pleadings contained in the petition that had a bit of petitioner number 2 alone has been filed who is representing the petitioner number one that is minor girl as her next friend.considering the nature of relief and the fact that the petition is directed against the parents of minor girl as well as her brother and uncle who are natural guardian and close relative respectively therefore the stand of petitioner number to that is boy as next front of petitioner number one is not worth acceptance. The court also held  that on the perusal of representation it is further revealed that it is weak and lack or relevant and necessary particulars and therefore the apprehension expressed is  misconceived

Conclusion: So  the Punjab and Haryana High Court has refused to grant any protection to the runway couple where the girl was minor of the following that the boy who the girl had allegedly eloped with cannot be the next friend. Thus the court held that there would be no cold relief for minor girl who eloped with boy.
