UT approaches SC against HC orders

In this post, we will discuss about the case where the UT approaches Supreme Court against the High Court’s orders.

Facts of the case: The high court in 2019 has upheld a Central Administrative Tribunal (CAT) order that had quashed a UT education department directive, terminating the services of 1,176 teachers in May 2018. UT stated that the entire selection process had got vitiated and hence it should be held again.

Legal Issue: Whether the UT approaching Supreme Court against the High Court orders are valid and justified or not.

Legal Opinion: As per legal opinion, after the junior basic teacher recruitment scam was unearthed in 2016, services of these teachers recruited under TGT (trained graduate teachers), JBT (Junior Basic Teacher) and NTT (nursery teacher training) cadres in 2015, were terminated without any prior notice following which they had moved the CAT. A year later, the tribunal, in its judgment on May 6, 2019, had set aside the education department’s order. The order was upheld by the high court and had allowed UT to sack only those teachers whose names figured in the probe report.

Decision of the court: The Supreme Court on Monday issued a notice on UT’s plea challenging the high court order of 2019 in the JBT-TGT recruitment scam case.

Conclusion: The UT had advertised the posts in 2014 and the test was conducted in February 2015. The appointment letter to selected candidates was issued in August 2015, a year before the scam came to the fore in 2016. Therefore, the Supreme Court issued a notice on Monday on UT’s plea challenging the high court order of 2019 in the JBT-TGT recruitment scam case.
