Background Facts

  1. Ajay Saini and other employees filed this contempt petition when Kapur failed to implement the February 10 orders of this high court that had set-aside the Haryana government’s decision to shift the staff from the regulatory wing or the regional transport authority (RTA) to its commercial wing (state roadways) and vice-versa.
  2. In the contempt petition, the employees have stated that the department was yet to implement the orders despite the state’s decision being held invalid. The court will hear the contempt petition on September 14. Meanwhile, the department has challenged the February orders. In October 2020, the department had decided to shift the employees, making several members of the staff unhappy.

Courts Observation & Order

The Punjab and Haryana high court has issued a notice to Haryana principal secretary for transport Shatrujeet Kapur on a plea seeking action against him for defying the orders against shifting employees to another wing.

The court found it completely bereft of rationale. These orders were passed on a bunch of petitions by the RTA inspectors and sub-inspectors deputed to its commercial wing. The high court had observed that there was no indication as to on what basis select employees of the regulatory wing have been subjected to deputation or deployment, and even though the advocate general stated it was an ongoing exercise and will cover the others, he had not explained the basis for selection.
