Punjab consumer panel orders Rs.35 lakh for couple who lost newborn in Dayanand Hospital Ludhiana owing to Medical Negligence by Staff.

Facts:

Appearing for the complainants, Pulkit Kapoor and Karan Kapoor, advocate Bhavnik Mehta had submitted, Entire process of surgery was left at the mercy of nurses.

The result was evident; the doctor was completely unaware of the process of labour. The infant, still inside the womb, had passed and inhaled the meconium (stool). The meconium was thick and old. It clogged the infant’s lungs and blocked the airway and caused hypoxia at birth. This resulted in the death of an infant within one day of of his birth at the referred Dayanand hospital.

Judgment: The Punjab state consumer disputes redressal commission has directed a private hospital in Ludhiana to pay Rs.35 lakh compensation to a couple who lost their newborn child due to medical negligence of its doctors in july2016.

In its judgment running into 94 pages, the commission headed by justice Paramjeet Singh Dhaliwal said that Although the loss suffered by complainants due to deficiency in service and medical negligence of opposite parties No. 1 (Handa Hospital) & 2 (Dr Pratibha Handa) cannot be cannot be compensated in terms of money, yet in view of the totality of facts and circumstances of the case, we award lump-sum compensation of Rs 35 lakh to the complainants, along with interest at the rate of 8% per annum from the date of filing of the complaint till realisation, on account of the  of the sudden loss of newly born child of the complainants and resultant mental agony, harassment, avoidable pain, sufferings caused to the complainants.

The commission also directed the defendants to pay Rs 33,000 as litigation expenses to the complainants.
