Background Facts

  1. Seerat Kaur is in jail for the past four years for allegedly killing her husband Aikom Singh Dhillon. She sought a regular bail through her counsel in the court of district and sessions judge Rajinder Singh Rai.
  2. Darshan Singh Dhillon, brother of Aikom, said they have been fighting for justice for the past four years and opposed the bail application, as the statements of Gurniwaz and prime witness Tul Bahadur, an auto driver, were yet to be recorded. If Seerat is let out on bail, she will definitely influence the witnesses.
  3. Tul Bahadur is yet to record his statement as police failed to produce him in court. He had last appeared in court in December 2017, but his statement was not recorded. He is suspected to have moved to his native place in Nepal
  4. Police have also not been able to produce the BMW car in court in which suitcase stuffed with the body was loaded outside the house of Aikom.
  5. Tul Bahadur, in his statement to the police, had mentioned the car in which he saw Seerat loading the suitcase from which blood was oozing. BMW is now parked at Mataur police station.
  6. Seerat, lodged in Ropar jail, was recently accused of ferrying drugs to the prison. She was caught at the jail gate with drugs hidden in sanitary napkins. She was booked under the NDPS Act.

Court’s Decision

The district court has rejected the plea of bail on the ground that records of the witnesses are yet to be recorded. It also re-schedule recording of statement of lone eyewitness, Gurniwaz Singh, son of Aikom and Seerat after counsel cited absence of Seerat on that day.
