1. Background: Seemarani Pandab, the daughter of a deceased physical education teacher, was initially denied a job opportunity due to a 2010 government circular that prohibited married daughters from benefiting from compassionate recruitment.

2. Court’s Verdict:

The court deemed the government’s policy of disqualifying married daughters and excluding them from consideration as “discriminatory” and “retrograde.”

 Justice SK Panigrahi (single-judge bench in this case) ordered that Seemarani Pandab be reconsidered for the job, replacing her father who had passed away while serving as a physical education teacher in Bhadrak govt. school.

 The court emphasized that the yardstick for compassionate appointments should be the dependency of dependents on the deceased government servant, and marital status should not be an impediment.

 Such a prohibition based on marital status was declared “plainly arbitrary and violative of constitutional guarantees,” including Articles 14, 15, and 16(2) of the Constitution, which relate to equality and equal opportunity.

 Considering the passage of time and the interest of justice, the petitioner’s age should not be a factor in evaluating her suitability for the job.
