Post covers Omaxe Chandigarh Extension Complaint for Delay in possession and fined for not handing over the flat to buyers on time.

Order has come from Punjab Real Estate Regulatory Authority wherein Omaxe Chandigarh Extension has been asked to pay fine on Rs 76 lakh paid by buyer.

Interestingly the possession has to be delivered in 2018 but till date the project was not completed.

Allotment letter was issued in March 2015 and handover was to be given in 42 months.

So RERA Punjab Authority has asked builder to pay interest on the amount invested till the possession is granted by Omaxe Chandigarh Extension.

The case relates to project “The Lake” comprising of residential apartment having an area of 213.68 square metres.

Inspite of having a bank loan, complainant suffered in the hands of Omaxe Chandigarh Extension.

The Question of existing big water body in the project ‘The Lake’ was amiss.

Complainant prayed that Builder be directed to give valid legal possession after obtaining OC/CC from competent authorities plus the interest for the delay till the date of hand over of apartment.

Builder tried to take benefit of Corona and excluding public holidays but court vehemently rejected their plea. Despite of reminders, Omaxe Chandigarh Extension chose not to reply to complainant. Au

Thus RERA Punjab complaint against Omaxe Chandigarh Extension was filed.

As usual, Builder tried to shift the blame of delay on Complainant for not making the payments on time but court found it to be just a mere allegation without any substantial proof.

Finally, court ordered interest on the amount invested with rate of interest of 10.85% as per prescribed 2017 rules of Punjab RERA Authority till a valid offer of possession is made with occupancy certificate.

Once again Punjab RERA Authority Chandigarh proved champion for the rights of homebuyers and brought justice for them.
