Divorce Cases Cannot Be Kept Pending Indefinitely: Punjab & Haryana High Court

In a significant observation, the Punjab & Haryana High Court has stressed that unnecessary delay in divorce proceedings amounts to ignoring the dignity and emotional well-being of the parties involved. The Court observed that matrimonial disputes cannot be allowed to remain pending for years without meaningful progress.

While hearing a pending matrimonial matter, the High Court directed the Chandigarh Family Court to conclude the divorce case within one year. The Court noted that Family Courts were established for speedy and effective resolution of family disputes, and prolonged delays defeat the very purpose of the Family Courts Act, 1984.

The Bench further remarked that keeping matrimonial disputes pending for an uncertain period adversely affects the lives, mental peace, and future of both parties. The Court emphasized that justice delayed in such sensitive matters can become a source of continued emotional hardship.

The High Court also took note of repeated adjournments and delays caused due to late filing of replies and lack of timely proceedings. It stated that unnecessary dates and procedural delays should not become the norm in matrimonial litigation.

This ruling sends a strong message that family disputes require prompt judicial attention and that courts must ensure timely disposal to protect the dignity and rights of individuals involved in matrimonial conflicts.
