For the internal structure of your legal arguments within the reply, you should use the IRAC (Issue, Rule, Application, Conclusion) or CREAC (Conclusion, Rule, Explanation, Application, Conclusion) frameworks. A well-constructed legal paragraph should include:

  • A Topic Sentence: This serves as a “roadmap,” stating the main point or issue without getting into citations.
  • The Rule: Clearly state the governing statute, regulation, or binding precedent.
  • An Explanation: Provide a brief analysis of how the rule operates in this specific context.
  • The Application: This is the most critical step, where you apply the legal rule to the material facts of the case to show how they support your conclusion.
  • A Concluding/Transition Sentence: Close the paragraph with a takeaway that resolves the point and bridges logically to the next topic.

Hypothetical Example of a Para-wise Reply

From the Plaint (Opposing Party):

  1. The Defendant entered into a written contract with the Plaintiff on January 1, 2023.
  2. The Defendant failed to make the scheduled payment of $5,000 due on June 1, 2023.

Your Written Statement (Para-wise Reply):

  • Para 1: With respect to paragraph 1 of the plaint, it is admitted that the parties entered into a written contract on January 1, 2023.
  • Para 2: With respect to paragraph 2 of the plaint, the Defendant denies the allegation. While the payment was not made on June 1, it is submitted that the Plaintiff had previously agreed in writing to an extension of the deadline to July 1, 2023.

In this example, the reply stays aligned by using the same numbering and avoids bundling by addressing the contract existence and the payment failure in two distinct sections.
