He stated in front of the court that he had availed a housing loan of Rs.48 Lakh in May 2014, and was regular in payment of the instalments without any default. In December 2018, the bank had added Rs.8,850 in the loan account without his knowledge and consent.

When he inquired about the amount, he was informed that the said amount was the lien marking charges on his property. He then approached the manager to inquire about the charges and question why the bank had not imposed the charges at the time of sanctioning the loan, the manager answered that there were no lien marking fee prescribed by the Chandigarh Housing Board (CHB) at the time. After this the complainant moved to the forum.

The bank argued that the bank had deducted Rs. 8,850 from the loan account on December 21st, 2018 from the loan sanctioned in April 28th 2014. These charges were deducted as processing charges for obtaining the permission to mortgage or lien as according to the policy of the CHB. Therefore the complainant had no right to agitate the amount.

The forum however allowed the complain and ordered the bank to credit Rs. 8,850 to the complainant’s loan account and to pay a compensation of Rs. 2,500 on account of mental agony, harassment and litigation expenses.

Though all the banks these days have consumer helpline and helpdesk numbers but at times where the bank is arrogant enough to ignore the problem and deny to accept the same, then consumer courts can bring quick relief.
