The District Legal Services Authority (DLSA), Chandigarh, granted Rs 10 lakh compensation to the victim’s relatives who were murdered in 2016. The family comes from Assam. In July 2016, Maipal, 55, owner of the dhaba, was killed by a 19-year-old helper.
Facts of the case
The FIR was registered on a complaint filed by EshwarJall, the son of the deceased, Mahipal, who told the police that his father and younger brother were running a dhabha near the powerhouse in Sector 42. He said they were from Assam, and his father had the help of a young man from Dibrugarh in Assam. Eshwar told the police that there was an altercation between his father and the boy. The next morning, when he returned from work, he saw that his father was dead and that the boy had fled. Following the trial of the juvenile justice board, the case was transferred to the additional district court and to the judge of the sessions, Rajeev Goyal.
Four years later, the court found the youth guilty pursuant to Section 302 of the Indian Criminal Code, and on 5 August 2020 the court granted “rigorous life imprisonment” with the possibility of remission, commutation, etc. and a fine of Rs 50,000 to the youth. The court also recommended that the family of the deceased be compensated for being too poor and forwarded the case to the legal service authority.

“The file was forwarded to the DLSA on 11 August and the family was contacted. However, they moved to Assam and reached the city on 3 September, “said Ashok Kumar Mann, Chief Judicial Magistrate-Cum-Secretary of DLSA Chandigarh. Mann added that Justice Jaswant Singh, Executive Chairman of the SLSA, Chandigarh, directed the LSA to ensure that the victim’s claim for compensation was decided without delay. “In view of the poor income of the deceased’s family, compensation for Rs 10 lakh has been granted to the victim’s family,” he said.
