
Departmental Inquiry is supposed to be finished in a Time Bound Manner Rules CAT Tribunal Chandigarh quashing the review petition of UT Department against its own employee of Chandigarh Police serving as SI (Sub Inspector) .
Currently the SI is facing departmental for furnishing wrong information regarding an ex-India leave .
The SI earlier was also involved in controversy when he filed petition to seek promotion to DSP cadre /rank in Central Administrative Tribunal Chandigarh.
The issue arose when the SI applied for leaves to meet his son in Canada but the Canadian embassy denied the visa since he was chargesheeted for supplying wrong information. The enquiry was opened and as a result he couldn’t go.
The court earlier had ordered to finish the enquiry within 4 months to UT Police Administration for which they again sought extension of time through a review petition in CAT Tribunal Chandigarh.
The reason that department gave was they missed the deadline to finish the inquiry in a time bound manner which was considered a too far fetched argument.
Apparently the vindictiveness of department is clear but the inquiry must be completed within the framework of law in a reasonable time frame.
The CAT Tribunal Chandigarh is quick in resolving service matter disputes when the rights of an employee are in danger.
