Brief facts of the case are:
1 Complainants booked two flats under EWS (Economic Weaker Section) at 12 lacs each in Nov 2012 & March 2014 respectively.
2 Possession was to be delivered in two years but there was no booklet describing the same (a drawback).
3 Since there was no construction . Hence possession couldn’t be offered.
4 Duo moved to the consumer Forum in July 2018.
5 Builder Reply- Duo misrepresented them under EWS category by not giving any affidavit or proof that both earned income below 3 lacs. Domicile certificate as per agreement was also not given.
6 Merit- The builder did not produced any document to show that they possessed approvals from competent authorities and thus violated the provisions of Punjab Apartment and Property Regulation Act (PAPRA).
7 Order- Therefore complainants were entitled for relief. Builder ordered to refund Rs 4.8 lakh invested so far at 12% interest per annum, along with 25K as compensation for mental agony and harassment and Rs 5000 as cost of litigation to each of them.
