COACHING INSTITUES HAVE TO RE-FUND FEES OF NON-UNITILIZED PERIOD.
Education is one of the top businesses at present time. Even the recession doesn’t affect it. Every person want that his/her child should get admission in the best Coaching Center so they will always be ready to pay any amount of coaching fee of to these Coaching Centers.
But when they got dissatisfied or because of any other reason their child is unable to attend the classes or they ask for refund of fees but institutes deny to refund. By this act parents of child suffer huge monetary loss.
But now institutes have to refund the money as held by Chandigarh District Consumer Disputes Redressal Forum in a case of Harsh Vardhan Sikka (a minor student).

Let’s see Facts of the case:
Harsh Vardhan Sikka had got admitted in FIIT JEE’s Pinnacle- a 2 year integrated school programme in 2018. He was a regular student and attending all the classes in the school where coaching center was running a program.
When he took admission, method of teaching described to him was different from the method in which they were teaching and he got dissatisfied.
Complainant is a bright child, even though he was unable to perform well in his class tests and also harassed and taunted by the teachers that he is not competent. Father of the complainant reported about the matter to the authorities of the coaching institute but nothing changed.
On Aug 6, 2018 after he got dissatisfied, he withdrew from said course and also sought refund of the fee paid to the institute but refund request was denied.
FIIT JEE gives his reply that on time of admission complainant and his parents were made aware of all the terms and conditions of the course, then they had signed the papers and denied that complainant is entitled for any refund.
After considering evidences put on record, Forum held that non-refund of fees of dissatisfied complainant by teaching methodology and style of FIIT JEE amounts to gross deficiency in service on part of the institute. It amounts to unfair trade and practice, as they cannot retain the coaching fee for the unutilized period. So, institute acted unfair.
Forum orders the coaching institute to refund the fees because if any child, after joining the coaching institute, fails to cope up with the coaching schedule for the whatsoever reasons, he cannot be penalized by way of forfeiture his money and also directed to pay Rs. 15,000 as a compensation for causing harassment and litigation cost.
So, no institute can refuse to refund the fee of the unutilized period. It is students and his parent’s right to get back the fee, if they not then legal action can be taken against them.
