Mayfield Gardens has moved to High Court seeking quashing of DTCP’s order cancelling their license.

District Town and Country Planning (DTCP) has issued show-cause notice on January 24 to developers of Mayfield Gardens, seeking clarification so as to why they failed to complete infrastructure inside the township without which occupancy certificate (OCs) cannot be granted.

Reply was sought from Developers till March 17, 2020:

                However Court while listening to petition asked the DTCP to look into the issue without any biasedness  or unduly being swayed by they said orders passed earlier by this authority in this regard.

Mayfield Gardens is a plotted township of 327 acres situated at sector 49/50 being developed by consortium of five builders in 2002, 2004.

It is on the request of residents on account of lack of inadequate infrastructure facilities that DTCP chose to cancel their license for which show-cause issue was issued.

Though the appeal against said order can also be made to Chief Town Planner, Haryana at Sector 18, Plot no. 3 Chandigarh who will be acting as the first Appellate Authority.

The Appeal can be defined under the Haryana Development & Regulation of Urban Areas Rules, 1976 under Section 30 Form and manner of Appeal [section 19].

  1. Form and manner of appeal [Section 19]. – (1) Every memorandum of appeal shall be written on a standard water marked judicial paper in the form of narration and it shall set forth concisely and under distinct heads the grounds of objections to the order appeal from and also the relief claimed.

(2) The memorandum of appeal shall bear a court fee stamp of ten rupees.

(3) The memorandum of appeal shall be accompanied by an attested copy of the order appealed from.

(4) The memorandum of appeals shall be addressed to the Secretary to Government, Haryana, Town and Country Planning Department, Chandigarh, and shall be signed and verified in the manner in which plaints are signed and verified.
