In the high-profile case of the Amandeep murder of Jammu, the then Senior Superintendent of Police (SSP), Jammu, Manohar Singh, then SHO of Gandhi Nagar Police Station Sultan Mirza and the late Sub-Inspector, Satnam Singh are acquitted on Monday after an 11-year trial. The court provided the accused the benefit of doubt, including Nagar Singh, Jagar Singh, Rakesh Singh, Manohar Singh, Sultan Mehmood Mirza and SH Bukhari.

Facts of the Case

Amandeep Singh, son of former National Conference (NC) legislature Deepinder Kaur, was shot outside his home in Shastri Nagar, Jammu, allegedly by Jatinder Singh, alias Raja, son of a prominent J&K businessman, Choudhary Nagar Singh, alias Nago, on 29 August 2009. Key accused Raja died in suspicious circumstances in Udhampur prison in 2017.

  • Aug 29, 2009: Amandeep Singh was murdered in Shastri Nagar, Jammu.
  • Sept 18, 2009: Manohar Singh, who was the SSP, was suspended at the time for his supposed role in exchanging the weapon used in the murder.
  • Sept 28, 2009: Manohar Singh and then SHO, Gandhi Nagar, Sultan Mirza and IO SI Satnam Singh were arrested.
  • Mar 25, 2011: The Udhampur prison superintendent was arrested for reportedly engaging in a plot to murder the uncle of the deceased Amandeep Singh.
  • Mar 5, 2014: Jammu, Judge of the Court of Additional Sessions, denied Manohar Singh’s bail.
  • May 13, 2014: Manohar Singh was bailed out by the Supreme Court and released from KotBhawal prison.

In his lengthy 178-page decision, the judge was furious at the ‘botched up’ trials. The then Senior Superintendent of Police (SSP) Manohar Singh and Gandhi Nagar police station SHO Sultan Mirza were all absolved in the murder case by the second additional session of Judge Jammu Virender Singh Bhau. The third officer, Sub-inspector Satnam Singh, who died during the trial, was also absolved.

The Court did not fail to notice and to suggest that the prosecutors, when conducting hearings and gathering evidence, behaved as if they were writing a film script and filming a thriller film, and thus could not be ruled out indulgence in the spinning of real facts and the use of false facts to try and induce the Court to come to a false conclusion. The Court could not escape the examination and record of the actions, action and position of the investigators and sound a note of caution to all investigators who are in the service of being cautious, cautious, alert, honest and competent in their dealings in the future, so as not to bring them to the task of their wrongdoing.

Furthermore, the prosecutor had wretchedly struggled to show the related facts relating to the incident and the role played by other accused persons in attempting to exchange the suspected weapon of the crime to film the key accused and to alter the bullet during the trial on the basis of evidence that was inconsistent, ambiguous and suffered from factual inconsistencies, loopholes and broken connections, without re-emergence. As a result, the prosecution against these defendants collapsed and was thus dismissed to the point that it pertains to those convicted people.
