Insurance company told to pay up for rejecting claim

Introduction : In this post we will discuss about the decision of district consumer dispute redressal forum in which it had directed the general insurance company to pay compensation of rupees 25000 for rejecting the genuine claim of a complainant.

Facts of the case : Mahavir Singh had purchased a Tata Safari car from Dalbir  Singh, a Panipat resident, and got the ownership transferred in  his name along with the insurance policy. The insurance was valid from September 10 2016 to September 9 2017 and the IDV was rupees 2.8 lakh full stop later the vehicle met with an accident while saving a stray animal in Panipat. As a result of this the car got damaged. as the claim was submitted the company of a surveyor  and claim was offered to be settled on a non-standard basis after deduction. Subsequently the insurer repudiated claim by observing that damage did not correlate with the cause and nature of the accident. The surveyor concluded that the accident had taken place two and half months before the alleged date.

Decision of the district consumer dispute redressal forum :

The district consumer disputes redressal forum directed IFFCO- Tokiyo general insurance company to pay rupees 25000 for rejecting genuine claim of a complainant and directed to settle and pay the claim of rupees 2.8 lakh to the complainant along with interest at the rate of 8% per annum from the date of repudiation of the claim January 22 , 2018 till realisation. The forum also noted that the surveyor concluded that accident had taken place two and half months before the alleged date and even in this period the vehicle was insured.

Conclusion : Thus the forum in the case in hand directed the insurance company to pay compensation for rejecting the genuine claim of complainant.
