Punjab and Haryana high court dismissed the Punjab state governments plea for early hearing on its appeal against the single bench order that set aside the appointment of retired IAS officer Suresh Kumar as chief principal secretary to chief Minister Captain Amarinder Singh.

FACTS

A 1893 batch I AS officer Kumar was appointed immediately after the Congress government took charge in Punjab in March 2017. the post created for the first time in Punjab was stated to be equivalent to a Cabinet secretary  of the central government.Kumar was paid 2.5 lakhs per month. His appointment was challenged by Ramandeep Singh Claiming that Kumar had became a de facto CM and was empowered by the government to take decision’s on behalf of CM. His appointment was quashed by a high court single judge bench. The single judge bench had held that Kumar was holding the public office without authority and overriding powers were given to himwithout anyaccountability.The case has not been taken up for nearly a year now due to covid19 outbreak The state seeking early hearing had argued that since it has been painting for a long. Hearing to be prepone. It had also argued that issue needed to be settled once and for all.

LEGAL OPINION

Early hearing application are give to pre pone the hearing date of the case. In the above case the next hearing date is coming shortly than a month so there is no necessity for pre-poning the hearing as the court ordered. A survey says that there is a relation between the early hearing and early disposal of the case.

CONCLUSION

The high court bench of Justice Jayanti Singh and Justice Sant Prakash dismissed the plea for early hearing observing that date of hearing is fast approaching, which is March 18 hence there is no ground to entertain the prayer for advancement.
