Facts:

Bhardwaj had approached Fortis Hospital in February 2017 and was advised to undergo laparoscopic ventral mesh hernioplasty. According to the com- plaint. Bhardwaj was operated upon in April 2017, but no significant improvement was noticed. He then underwent an explorarory laparotomy, but the problem persisted and his condition only worsened.

In its response, the hospital said Bhardwaj had swelling in the umbilical and epigastric region, which was increasing. Therefore, surgery was the only option. Although the surgery was advised in December 2016, the patient did not undergo preanaesthesia check-up for a long time. After the surgery, all vitals Were within permissible range. A repeat abdominal X-ray Revealed dilated bowel loops and multiple air fluid levels, necessitating an exploratory laparotomy in April 2017. The patient was discharged in stable and satisfactory condition, it said.

While dismissing allegations of medical negligence, the com mission held: “The complainant was not explained about total expenses for the second surgery. Since the patient was provided inadequate information to take proper and informed decisions. There have been lapses… Hence to that extent, hospital is deficient in service and indulged in unfair trade practice.”

Judgment

Limited and Fortis Hospital, Phase 8. Mohali, have been directed to pay 23 lakh with 9% interest to a Sector 70 family for failing to give complete information about treatment expenses.

Disposing of a complaint filed by Satish Bhardwaj, an advocate, who died during the pendency of the case, the Punjab Consumer Disputes Redressal Commission also directed the hospital to pay 11.000 as litigation costs to his wife, son and daughter.
