The petitioner Abhishek Garg, submitted that in August 2018 he had ordered a chessy garlic stick worth Rs 144 and three soft drinks costing Rs 99 through Swiggy, a food delivery mobile app. He realised that he was charged Rs 4.50 as GST on the soft drinks while he was already paying the MRP, which he contended was illegal under the Consumer Goods (Mandatory Printing of Cost of Production and Maximum Retail Price) Act 2006.

Consumer Complaint against Swiggy for GST on Soft Drink

Swiggy, on the other hand claimed that it was only intermediately and acting as a collecting the payment on the charge of the merchant, who charged all applicable taxes on the bill. So there was no deficiency on the part of its services.

The District Consumer Disputes Redressal Commission, Pnchkula observed that Swiggy is not providing a purely gratuitous service to its customers without any consideration. Swiggy is an online shopping portal and works as a link between the buyer and seller concerned for the  purpose of delivery and is certainly not a charitable organisation.

Terming Swiggy guilty of unfair and deficient services the commission directed to refund Rs 4.50 along with interest @9% per annum with effect from the date of filing a complaint till its realisation. Apart from paying Rs 10,000 to the complainant for mental agony, harassment , litigation charges the company was also ordered to deposit Rs 10,000 in the account of Haryana State Council for Child Welfare.
