EXPLAIN BAIL TO DRUG CASE ACCUSED: HC TO SIRSA SESSION JUDGE

The Punjab and Haryana High Court has asked the Sirsa sessions judge to explain about his order granting bail to an accused in a drug case.

The sessions judge had granted bail to the accused despite the fact that he had filed a similar petition before the high court. The judge has Sirsa court has also been asked to explain how he granted bail without considering the bar imposed by section 37 of the Narcotic Drugs and Psychotropic Substances Act (NDPS).

NDPS Bail Explanation From Sessions Court by High Court

Justice HS Madaan observed that apart from the explanation, the sessions judge is also to report whether pendency of petition before high court was bought to notice by Naveen Kumar, public prosecutor for the case or any other concerned police officer. He also asked the Haryana advocate general’s office to convey the entire matter to the director, prosecution, Panchkula (Haryana) as well as director general of police Haryana, so that necessary action is taken against the official at fault.

After doing the needful the state will intimate in writing in this regard as per High Court.
